项目摘要

近年、社会の「知的財産」に対する興味や普及推進への関心が高まり、知的財産戦略本部による「知的財産推進計画」でも学校教育への導入の推進や充実する方向性が書かれている。中学校と高等学校の新学習指導要領では、複数の教科・科目で「知的財産」が取り入れられ、学校教育の場で、知的財産教育(知財教育)が行われることになった。「知的財産権」とは、単独の権利が存在するのではなく、著作権や特許君などの産業財産権、さらには、育成者権、営業秘密などの「無体財産」の権利を束ねた総称である。近年、情報モラル教育の側面から著作権について学習の対象とされている。著作権はこれまでも教育研究が多く報告されているが、しかしそれは法解釈を学習するだけ、あるいは、違法性を指摘して複製や模倣を禁止する教育であることが多いが、禁止教育はそこからの発展は考えにくい。本来、模倣と創造は背中合わせの関係であり、商業教育における創造性を重視した知財教育の考え方の導入が重要であると考え、本研究では、著作権と産業財産権を統合した知財教育について、高校商業教育への知的財産マネジメントの学習の導入と評価方法の実践を通して検討した。商業高校の学習では「商品開発」をはじめ、「経済活動と法」「情報処理」などで、知的財産(知財)の創造、保護、活用の3側面が取りいれられ、商品開発の学習を通した教育活動は、オリジナル成果を創出するためには断片的な知識の習得ではなく、資料を読解し、自ら課題解決を図る学力が要請される、まさにPISA型の現代学力の養成であり、現代日本で今まさに求められる内容であることがわかった。日本の知財教育は、世界的に見ても学校教育の場で知財教育が行われることは先進的であるが、しかし、複数の教科を横断する状況において、どのような目標をもち、どのように展開していくのか明らかになっていない。そこで、本研究では国内外で施行されている教育実践から、今後どの商業高校でも実施しうる知的財産マネジメントを導入した教育カリキュラムの構築と評価方法の完成を目指した。
