児童養護施設職員の入所児童の権利に対する意識、子育て観、家族観を明らかにすることを目的に、全国の児童養護施設の職員に対し意識調査を行った。1. 調査の概要(1) 調査実施期間 1998年12月1日〜12月20日(2) 調査対象等 各都道府県及び政令指定都市にある児童養護施設を無作為に2カ所ずつ抽出し(但し、宮城県及び千葉県のみは1カ所)そこで働いている保育士及び指導員を調査対象とした。調査票の配布及び回収は全国児童養護施設協議会を通して郵送で行った。全調査対象施設116施設の内111施設から調査票が回収された。2. 調査結果の概要施設生活における職員による子どもへのかかわりのあり方は現在、子どもの自律性の尊重と管理・保護的かかわりとの間を揺れ動いている。児童に関する権利条約の批准以降、子どもの市民的自由権保障の必要性が論じられながらも今回の調査においても管理・保護的側面が重視されていることが明らかになった。例えば、「役割や当番」「日課や決まり」「お小遣いの職員による管理」「持ち物検査」については、9割以上の職員がそれらの必要性を感じている。しかしながら一方で「子どもの意見による日課の変更」「子どもの呼称に対する配慮」「子どもの権利内容の周知」においても8割前後が必要性を感じており、子どもの自律性を尊重したケアのあり方も模索されているようである。現在入所児の権利保障を目的として取り組まれているオンブズマン、職員の倫理綱領、子ともの権利ノートの必要性については、いずれも半数の職員が必要性を感じている一方で、それらの取り組みに対する否定的見解をもつ職員も半数近くいる。集団性を重視し、子どもを管理しようとする職員、子どもの自主性や個性を尊重し、子どもであっても市民権は保障されるべきという意識をもつ職員、及びそれらの間で揺れ動いている職員の存在が本調査を通して明らかになり、ケアのあり方を検討するする必要を感じた。
