直接に、あるいは代理人を通して子どもの意見表明権を確保すべきとする理論は、子どもの権利論の中から発展してきたものである。そこで、本年度は、子どもの権利に関する基礎的研究として、家族の自律性と子どもの権利に関する考察を行った。まず、虐待や事故、監督過失を理由として子どもが親を訴える不法行為訴訟をテーマに、家族間の争いの中に法が介入すべきか、また子どもの利益や権利をどのように保護すべきかについての研究を行い、「子どもが親を訴える-親子間の不法行為訴訟-」として発表した。本研究では、アメリカ各州の親子間の不法行為判例および論文から検討、考察することはもとより、新聞、統計資料から内外の親子間争いの状況を調査することにより、現代的課題を追及した。そして、これまで、家族のプライバシーや家族の平和を保護するため法の不介入が正当化されていたのは、主に家庭の中の親を保護するためであり、そこには子どもの利益や権利の視点が欠けていたことを明らかにした。次に、アメリカで採り入れられている、非行少年の10代裁判(ティーンコート)が、家族へもたらす影響について考察し、「子どもおよび家族の自律性とティーンコート」として発表した。未だわが国で馴染みのないこの制度の研究については、文献資料からの考察はもちろん、アメリカ・ケンタッキー州、カリフォルニア州、ネバダ州に赴き、実際にティーンコートを傍聴し、司法関係者にヒアリングすることにより行った。そして、子どもが権利と自律性を持ち得るためには、家族が国家の介入を容易に許すのではなく、自律的に家庭を運営していける能力を身につけることが重要であり、そのために、ティーンコートの果たしうる役割は大きいことを明らかにした。他に、親子間の問題として、インディアンの子どもの養子縁組訴訟に関する「In re Bridget.R」の判例研究を行い、学会誌に公表した。
