平成12年度に、「選択性の帰責」や「行為(者)の自由」、パターナリズム等の基礎概念についての理論的な検討を行った。その結果を踏まえて平成13年度にはまずパターナリズム事例についてのより詳細な分析を行い、更にそれ以外の法社会学的現象についての検討を深めていった。パターナリズムに関しては、その正当化に用いられるレトリックを、主に「拡張的侵害」・「心理的侵害」・"Welfare Cost Approach"・「共同体の優越」乃至は「道徳」のレトリックに分け(それ以外のものは「子供」のレトリックと「自発的隷属」のレトリック)、それらが殆ど全て「他者に対する影響」を主張するもの、即ち形式的に言えば、問題事象が「パターナリズムでは無い」と云う事を主張する言説である事を明らかにした。この事から、「他者への影響」や因果関係、そして事象に対する配慮義務の種類と範囲などは自明に画されるものでは無く、規範的乃至価値論的観点から(その意味で恣意的に)境界線が引かれている事が分かった。こうした観点を更に、法律上の「相当因果連関説」と「客観的帰属理論」の議論などに言及しながら一般化し、近年重大な社会的関心を引いている製造物責任(PL)の観念や実務やアメリカのタバコ訴訟における選択性の帰責様式の特徴を論じた。また、有名なマクドナルド訴訟と札幌のびっくりドンキー訴訟の異同を法社会学的に明らかにしながら、今後の日本の法観念・責任観念に如何なる変化が想定されるかを検討した。また、これも近年社会的な論争を巻き起こしている「責任無能力」の観念の思想的基盤について、PTSDや解離性人格障害を例にしながら検討した。予定よりやや遅れているが、以上の内容について整理した上で研究成果として纏めるべく現在も研究継続中である。
