平成14年度は本研究の最終年度であった為、これまでの成果を一層発展させると共に、研究のとりまとめ、及び今後の研究の種をみつけることを課題として推進した。具体的には、文化的環境権の柱となるべき都市の景観保全の法的仕組みの比較法的研究が、わが国では法学者の手によってはさほど行われていないため、条例レベルまで踏み込んだ研究が必要であると感じられた。そこでドイツを例に取り、連邦法、バイエルン州法、ミュンヘン市条例、の調査研究を行った。その際、たんなる文献研究にとどまらず、現地建築家、ミュンヘン市都市計画局担当官への面談もおこなった。その結果、ドイツでは19世紀末頃には野放図な建築行為がまかり通っていたところ、徐々に規制が始まり、第二次大戦後は、所有権すなわち建築の自由が、建築の「不」自由、と揶揄されるほど極端に制限解釈されていること、計画法は連邦、建築規制法は州、と管轄を分担していること、計画法に関しては緑地保全や文化財保護等をも取り込んだ総合的な建築規制体系が存在すること、建築規制法は州の権限ではあるがモデル法をつくることによって州によって規制のばらつきが無いように調整する仕組みが取られたこと、それでも昨今は細部において州ごとの差があること、具体的な規制権限は市町村レベルにおりていて条例でなされていること、建築されるべき建物と周囲との調和が図られているかは担当官の裁量が大きいこと、等が明らかとなった。今後はさらに条例策定レベルにおける住民参加の形態に焦点をあわせて研究を進めると共に、比較研究としてフランス、アメリカにおける制度とその運用を調査する必要があると感じているが、今後の課題である。
