项目摘要

本年度は,前年度に構築した理論に基づき,現在各地の公共事業をめぐって開かれているPI協議会や円卓会議,住民説明会などの場を例に,これらの対話の場を有効に機能させるための制度設計を行った.川辺川ダム建設事業においては,事業主体である国土交通省や農林水産省,地元農家及び水没地域などの利害関係が錯綜しており,基本計画策定以来20年を経た現在も総意の調整は難航している.熊本県は事業に対して中立的な姿勢をとることでこれらの利害対立の調整を行ってきたが,この合意形成手法のために必要な政治的判断がしにくくなっているのが現状である.この事例研究より,流域委員会などの合意形成の場を設けるだけでは複雑化した問題を解決することができず,広域行政において明示的な意思決定を行う機関が必要であることがわかった.そこでこのような意思決定機関の一例として,市町村合併における法定合併協議会をとりあげ,合併協議の長期化・慢性化といった問題に対処しうる指針の提案を行った.全国の市町村合併協議会の中から28都道府県に及ぶ計44件を選出し,資料とインタビューにより経緯や協議会の構成,個別の事情や留意点についての調査を行った.分析の結果,合併協議会の組織設計や運営を補助するための指針として以下の3点を提案した.(1)合併協議会が行政主導であれ,住民発議制度によるものであれ,その決め方についての十分な事前準備が本格的な協議の進行に大きく影響する,(2)合併に関係する市町村が多いほど協議がまとまるまでには時間がかかる,求心力となる市町村や目標の存在が協議の長期化・慢性化を防ぐことができる,(3)特に少数市町村による合併協議の際に,協議会の委員構成が協議の進行に影響を及ぼす.本研究により,社会基盤整備の合意形成過程に内在する問題点を抽出することができ,こうした問題に対処するための方策を実証的に示すことができた.
