1.ヒアリング本研究課題のため本年度は以下の主体へのヒアリングを実施した。(1)みずほ銀行グループ等いわゆる「サブプライム問題」が本年度7月以降、マーケットで顕在化したことで、証券化商品及び地方債について保証業務を行っているいわゆる「モノライン」会社の信用リスクが顕在化し、当初想定していた地域の再生のために必要なインフラとしてのわが国における証券化型地方債モデルの枠組みの再考が必要となったため、みずほ銀行グループ等、海外・国外におけるCDO等の証券化商品及び地方債を手がける当事者に対して聞き取り調査を実施、解決を要する事項の法的検討を行った。(2)日本格付研究所トムソンフィナンシャル、他日本格付研究所トムソンフィナンシャル等、サブプライム問題による仕組み債、地方債の格付け実務への影響と今後の実務の枠組みの変容の可能性についてのヒヤリングを実施し、上記サブプライム問題顕在化によるマーケット環境の激変に対してどのような問題が地方債及び地方再生の法的枠組みに生じうる課について、投資家サイド(特に地銀)の地域再投資とバーゼルIIの枠組みとの関係、解決を要する事項の法的・実務的検討を行った。2.研究会及びとりまとめ研究分担者3名による研究会を3回実施した。本年度は昨年度の成果を踏まえ、分担者による実地調査の内容の報告と分析及び日本法における地方再生の法的枠組みの検討の論理的な問題・論点のまとめを行う予定であったが、年度中に起きたサブプライム問題による研究テーマへの影響と枠組みの再構築を考えざるを得ず、これに必要なテーマについて整理を行った。各回のテーマは以下の通り。わが国における地方再生の法的枠組みのあり方について・・・証券化型地方債モデルの可能性と法的留意点・いわゆるサブプライム問題の法的構造と地方債モデルにおけるモノライン会社の役割への影響・いわゆるMBS、CDO等の証券化商品の時価評価の枠組みと今後の証券化型地方債モデル構築の際の留意点
