科学技術にかかわる法的諸問題を発見し、解決するための科学技術法という法分野の体系形成において、重要な領域を占める責任法領域の体系化を目的とする本研究において、研究最終年度である本年度は、民法改正論議における、一般不法行為法の改正論の動向を踏まえながら、科学技術の利用に起因する事故における、民事・行政責任の成立要件につき、検討を行い、以下のような新たな知見を得ることができた。(1)科学技術を利用する組織において、安全性の確保に向けて、どのような内部組織を置き、どのような手続を踏まえたかは、民事責任の成立要件としての「過失」の判断において大きな要素になるのみならず、利用にあたっての許認可等をなした行政において、そのような内部組織・手続の整備を許認可の要件として要求していたかどうかが、行政責任の成立要件としての「違法」判断の基準となる。(2)安全性確保のための内部組織については、科学技術の利用自体にあたる内部部局からの分離・独立性の確保が重要であり、この点に関しては、地方自治体における専門的な監査組織・機能の行政・議会からの独立性を強めるべきであるという議論が参考になる。(3)内部的な組織・手続の整備を、過失要件の具体化という形で明文で規定するかどうかについては、科学技術にかかわる諸活動において、無過失責任を特別法で規定している分野(原子力損害賠償)における取扱いにも考慮した上で、一般法としての規定化が検討に値する。
