We have aimed to research into workers who are employed by a enterprise but work under command of another one.Japanese enterprises limit the number of regular employees and utilize temporary workers, that is, subcontractors for a limited period, on-site subcontractors and so-called temporary workers (dispatched workers). And this Japanese styled employment contract is regulated in the labour laws.We researched the origin of this institution and followed this labour relation historically. Then we concluded that1) this institution was characteristic in pre-War Japan,2) however after the oil crisis this employment policy became the trend not only in Japanese enterprises but in the West enterprises.Namely enterprises slim core manpower, and then use temporary workers and on-site subcontractors to adjust manpower in accordance with business conditions.

我们的目标是研究受雇于一家企业但在另一家企业指挥下工作的工人。日本企业限制正式员工的数量，并使用临时工，即有限期限的分包商、现场分包商和所谓的临时工(派遣工人)。而这种日本式的雇佣合同在劳动法中也有规定。我们考察了这一制度的起源，并对这一劳动关系进行了历史跟踪。然后我们得出结论：1)这种制度是战前日本的特色，2)石油危机后，这种用工政策不仅在日本企业，在西方企业也成为一种趋势，即企业精简核心人力，然后根据业务情况使用临时工和现场分包商来调整人力。
