A Positive and Theoretical Study on Making the Farm Business Entity into Juridical Persons

本研究的结果概要如下。首先，重视基于土地利用的农场经营制度政策，明确了未来获得农地的经济单位；其次，我们对股份公司能否成为未来农业的支撑和推动力进行了论证，认为允许股份公司获得农业用地并不是一个好主意。三是考虑了农业法人问题，决定要赋予以土地利用为基础的农业固有经济单位一个固有法人，并实施对法人的优惠扶持政策。第四，对地方公共企业从事农业生产服务的问题进行了探讨，并对公共产品或公共利益的内容进行了考察。第五，对食品行业的整合进行了分析，明确了农户组成的小集团，在生产领域由饲养牛生产、饲养、饲料制造和堆肥制造公司组成，在销售领域由加工公司组成。

The outline of the results of this study are as follows.Firstly, we attached much importance to institutional policies for farm management based on land use, and clarified the economic units which get the agricultural land in the future.Secondly we argued whether the joint-stock company can be the support and driving force of future agriculture or not, and concluded that it is not a good idea to permit the joint-stock company to get agricultural land.Thirdly, we considered juridical persons in agriculture, and decided that we need to give an inherent economic unit of agriculture based on land use an inherent juridical person and carry out advantageous and supporting policies for the juridical person.Fourthly, we discussed the issues about local public corporation engaging in agricultural production service, and examined the contents of public goods or public benefits.Fifthly, we analyzed the integration in the food industry, and clarified that farmers organized small group which contain companies about feeder cattle production, feeding, feed manufacturing and compost manufacturing in the production field, and processing in the marketing field.
