1.研究領域を, 第1領域「大型事故と過失犯処罰」, 第2領域「火炎と過失犯処罰」の二領域に分け, 昭和61年度に引続き, 裁判例の事案を中心に詳細な事例分析を行い, これら二領域における過失犯処罰の実態と問題点について検討を加えた. その結果, 事故・火炎等の発生防止につき, 最終的な責任を負うべき会社の社長等の別事責任を問うことが困難な場合が多いこと, 過失犯の成立を認めた事案においてもかなり理論的に無理の見られる場合のあることなど, 事故・火炎等の発生防止等の見地から見て, 過失犯処罰が必ずしも適切な形で十分に機能していないことが明らかにされた.2 また, 1で検討の対象とした実例を中心に, 過失犯処罰の必要性の限界にかかわる, 事故・火炎等発生防止のための行政規制と過失犯処罰との関係を明らかにする作業を行った.3 さらに, 欧米諸国などにおける過失犯処罰の実状と理論について調査を行い, その成果をも参考にしつつ, 1,2で明らかとされた問題を理論的に位置付ける作業を行った.4 上記の検討の結果, 大規模な事故・火炎等が発生した場合において, 行政的規制並びにその違反を捉えた処罰では十分に対応しきれないこと, そのため過失犯の成立を認める要請が生じてきているが, これを広範に認めることには理論的に問題のあることが明らかとなり, これら二つの規制の中間的な規制・処罰を考慮していくことの必要性が示された. 今後は, さらにこの中間的な規制・処罰の基準についての研究を進め, 全体として適切な処罰のあり方について検討を加え, 具体的な提言にまとめる作業を行いたい.
