1.昭和63年度に引き続き、わが国における財産的情報の侵害の事例を裁判例を中心に収集・分析し、障害行為類型を明らかにするとともに、問題点の整理・検討を行った。その結果、秘密資料を一時持ち出してコピ-し、財産的情報を不正に取得した上で、資料を返還するという類型の行為が最近問題となっており、これに対して、裁判所は、窃盗・(業務上)横領という財産犯(財物罪の規定を拡張して解釈適用することにより処罰していること、そのような解釈は、窃盗・(業務上)横領などの財物罪の解釈としては問題を含むことが明らかにされた。2.(1)1の作業と並行して、外国における財産的情報の刑事罰による保護の制度について、検討を加えた。その際には、昭和63年度同様、研究分担者を西ヨ-ロッパ地域担当、北アメリカ地域担当の二つのグル-プに分け、各グル-プ毎に検討を加えた上で、その成果に基づいて全体的な討議を行うという方法が採られた。(2)西ヨ-ロッパ地域では、とくに西ドイツの不正競争防止法における刑事罰規定の方法・解釈等について分析を加え、不正競争行為としての財産侵害行為の把握に伴う問題点を明らかにした。また、北アメリカ地域では、アメリカ合衆国の統一トレ-ド・シ-クレット法の検討・分析を前提として、各州におけるトレ-ド・シ-クレットの刑事罰による保護の構造について検討を行い、併せてさまざまな具体的問題点についての分析を行った。3.1・2の作業・検討により、財産的情報の刑事罰による保護のアプロ-チとして、不正競争防止法の枠組みを用いるものと刑法の財産犯の延長として捉えるものの二つのものが明確化され、その得失等が明らかにされた。今後は、必ずしも十分な解決の与えられていない問題点についてさらに検討を加え、刑事罰による財産的情報の保護のあり方について、具体的な提言を取りまとめる作業を行っていきたい。
