本研究の成果の一部は、平成5年1月27日京都大学人文科学研究所刊行、山下正男編『法的思考の研究』の巻頭論文「法的思考とはなにか一義務論理学の効用性一」において発表された。本論文はそれに先だって自分で開発した義務論理学を、実際の法的諸問題に適用し、義務論理学の効用性を験証したものである。そして以下はその効用性のあらましである。(1)義務論理学もしくは法論理学は日本の現行憲法はもちろん民法、刑法をはじめとするすベての法文に適用可能である。ただし憲法前文は適用範囲から除かれる。(2)義務論理学と事実論理学とが互いに還元不能であるということから、法体系が事実学およびイデオロギーから独立しているという主張を正当化することができた。(3)いままでの法文の基本用語はホーフェルドによって提案されたものが用いられていたが、それを改良することができた。(4)法律で便宜的に使われ続けてきた構成要件なるものの論理学的身分を解明することができた。(5)いわゆる概念法学というものの素性をはっきりさせることができた。(6)法延論爭の基本構造を義務論理学と実験論理学を組みあわせることによって解明することができた。(7)いわゆる法的三段論法が欠陥品であること、そしてそれに代わる義務論的仮言三段論法(法的推論)を使うベきであることが提案された。以上7点のほか、義務論理学の応用範囲は今後とも、さらに拡大されることは疑いないと考える。
