地方自治体における外国人の選挙権問題については、ヨーロッパにおいて「移民(受入れ)大国」といわれるドイツで一定期間定住の外国人に地方参政権を導入したハンブルグおよびシュレースヴィッヒ・ホルシュタイン州法の合憲法をめぐって活発な論争が展開されてきたが、1990年10月31日の連邦憲法裁判所の違憲判決によって司法的には一応の決着をみた。外国人の地方参政権に関する主要な論点は、1国民主権の原理、2民主主義的正当性、および3連邦と州との統治構造の同質性の原理(28条1項GG)についてである。すなわち、1「国民」=ドイツ人(116条GG)というデーゼについては、定住外国人も「国民」に含めることが理論的に可能か、また基本法制定時と現代とでは「国民」概念に関して憲法変遷があったのではないか。2では国家レベルの選挙による「上から」の正当性だけでなく、地方自治体レベルの「下から」の正当性の保障も必要なのではないか、さらに3では地方自治について、地方自治体に地域のすべての事項を自己の責任で処理する権能が認められていることからすれば(28条2項)、必ずしも国家レベルの統治溝造と地方レベルのそれが「同質」であることは要請されておらず、むしろ地域的問題を円滑に処理するため地方選挙への外国人の参加を認める余地があるのではないか、という論争である。このような外国人の地方参政権に関する論議は、基本法と同様に自由と民主主義の原理に立脚する日本国憲法においても妥当するものである。とりわけ3に関して、地方自治体が国家的課題の遂行にとどまるのか、それとも地域「住民」(93条)が地域的事項を自己の責任で国から独立して処理するのか、という「地方自治の本旨」に関わって具体的に検討することがもっとも重要な課題と考えている。
