一審において社会保障行政における周知徹底義務を認め注目された永井訴訟は現在大阪高裁において審理は大詰を迎えている。この中で2つのことが明らかになってきている。一つは、具体的に行政がいかなる広報をなしうるか、という問題と並んで、たとえ要保障者の側に社会保障給付受給に至る過程で何等かの「瑕疵」があったとしても、その結果を当該社会保障給付の不支給という効果に結びつけることが社会正義に適うのか、という問題視角である。つまり社会保障行政の複雑化が進む中、要保障者に「申請」や「認定請求」等といった多様な行動を自ら行なうことが期待されている。たしかに第一次的には要保障者が自らアクションをおこすことが期待され、予定されているとしても、現実にそうしたアクションをおこすことが何等かの理由により遅滞したりした場合、その結果を要保障者に負わすことが果たして妥当なのか否か、という論点である。たとえば今回の研究の中でも、児童扶養手当の支給を管轄する部局について、永井訴訟が問題となった京都市においては区役所内の部局が担当していたが、大阪・京都府下のほとんどの市町(村)においては、生活保護を担当する福祉事務所の所管となっていることが明らとなっている。ことほどさように、いかなる部局が児童扶養手当を所管するかは優れて社会保障行政側の「都合」によるものであり、そうした事情を理解しそれにそった手続を行なう負担を第一次的に要保障者側に課すとすれば、逆にそうした手続過程での「瑕疵」について相当の範囲について要保障者に有利な処理が求められているというべきである。また「申請主義」を採用する生活保護行政においても、広報活動はきわめて低調である。とりわけ近来問題となっている難民認定をうけた外国人や中国帰還者など日本語を十分に理解できない人達に対する広報は不十分である。こつは、ドイツ社会保障法から学ぶべき点の多いことである。
