项目摘要

当初は胚、接合子、胎児、脳死状態及び慢性植物状態の患者、痴呆症老人などに共通する「非自己決定性」状況を考慮しながらこれらに有効な他者決定の原理としてパターナリズムの問題を取り扱う予定であったが、その後、国内外の各文献を繙くうちに該概念が上記の諸状況に一概に適合しにくいことを知りパターナリズムの定義と要件、及びその妥当性の根拠について予め整理する必要が生じた。医のパターナリズムを眼目に置きながら、まずは法的パターナリズムの成立条件を幅広く検討すべくJ.S.ミル、H.L.A.ハート、G.ドゥオーキン、J.フアインバーグらの主要文献を中心にその概念史を整理した。ここではその法的制約から由来する「個人の自由への干渉」という規定の重要性が確認されたが、同一の規定を医のパターナリズムの要件として特定するには及ばなかった。後者においてはむしろ「患者自身の善」をどう評価するかが重要であり、多分に価値倫理的な側面を含む。松井はこのような視点から生命医療倫理関連の文献を踏まえ独自の解釈をも織りまぜながら「医師のパターナリズム」について哲学的考究を試み、その研究成果の一端を論文の形で公表した。また吉崎は、主に、「対処能力competence」を欠く患者に対するいわゆる人工延命措置中断をめぐるアメリカの判例理論を検討した。従来は、患者の意思の推測により決定を行なう「主観的基準」と、最善の利益を考慮可能な合理的な他者が決定を行なう「客観的基準」のいずれかにより説明されてきたが、「患者と価値観を共有する他者」を想定する共同体的評価基盤が用意されている点で両者には共通する面があると考え、この最後の視点を踏まえた論稿を準備中である。
