インフォームド・コンセント(以下,ICと略記)は個人の自律的行動能力を背景とした同意と決定が前提となる.行動が自律的であるためには「意図,理解,非支配」の3つの条件が満たされる必要がある.しかし,知的障害があるために自律的行動能力が制限されている人たちの場合,このICの原則はどのように適用されるべきか,以下の3点について明らかにした.(1)意思決定能力の欠如の基準:合衆国やカナダでは個人の意思決定能力を推定するために既にいくつかの判定手段が開発されている.文献調査の結果,実際の判定に当たっては,客観的な基準だけでなく関係者の意見,個人の履歴,生活状況なども含めて総合的に判断する必要があり,また判定結果も単に能力の有無ではなく最低でも能力有り,部分的能力有り,能力無しの3段階に分類する必要があることが明らかにされた.(2)意思決定能力欠如の決定過程:本人に意思決定能力がない場合には,通常,その家族(保護者),医師などが意思決定を代行することになる.今後,高齢化に伴い意思決定できる家族(保護者)のいない施設入居者が増えることが予想されることから,法律的にガ-ディアン・ボードなどの整備が必要になると思われる.なお,ヒアリングにより我が国の精神薄弱者更生施設での在住者への医療手続きについて調査したが,ケース・バイ・ケースの対応が多く,制度化された手続きは整備されていない.(3)治療拒否への対応:法的に最も問題になるケースとして治療拒否に関連する合衆国の判例を収集したが,知的障害に関連したものは限られていた.しかし,死ぬ権利や精神科治療を拒否する権利などに関わる判例から,類推的に知的障害者のケースにおける問題を指摘することができた.

In addition, the rehabilitation program for the mentally weak in our country is designed to investigate and institutionalize the medical treatment of the residents. (3)The most important issue of the law is the collection of United States precedents and the limitation of knowledge.
