近年,医療・看護・福祉の分野でサービス受給者へのインフォームド・コンセントの必要性が強調されるようになった.本研究では,知的障害を持つ人に対してインフォームド・コンセントを実施する際に問題となるインコンビテンス(意思決定能力欠如)の概念とその判定方法について法的,心理的側面から検討を加えた.判断分析(主として米国,カナダ),関連文献調査及び知的障害者施設関係者からのヒアリングの結果を踏まえて議論し,以下のような結論に達した.(1)概念:インフォームド・コンセントの目的は個人の自律権を保証することにあるが,その前提となる個人の意思決定能力が疑われる場合にはインフォームド・コンセントそのものが不可能とみなされる.しかし,個人の意思決定能力は心理的連続体を構成し,それは知的能力等と密接な関連を持つものの,概念的には知能とは異なるものと考えるべきである.したがって,知的障害があることを根拠にインコンビテンスであると言うことはできず,障害の程度とは別に意思決定能力を評価することが必要である.(2)判定問題:知的障害を持つ人であっても一定のコミュニケーション能力があれば原則的には健常者と同様の意思決定能力を持つという前提で処遇すべきであり,判定を前提とすべきではない.サービス提供者から見て,障害者が明らかに不合理な判定を下していると認められた場合に限り,判定が必要となる.判定に当たっては既に開発が進んでいる客観的な判定尺度だけでなく,障害者の日常行動能力を良く知る立場になる養護者などの意見も積極的に取り入れることが勧められる.(3)課題:意思決定能力は教育的努力等により伸長するものである.今後は自己決定機会の拡大を通して,障害者が意思決定能力を発揮・開発できるような組織的努力が望まれる.
