项目摘要

本研究は、新たな証拠収集手段として導入された「証拠収集等への協力及び訴追に関する合意」（以下「合意制度」と呼ぶ。）が適正に運用されるべく、裁判所が果たすべき役割を考察するものである。本年度は、まずアメリカの答弁取引における裁判所の役割を調査しつつ、その理論的背景を考察した。米国では各法域によって、検察官と被告人の間の協議・合意をどのように裁判所が審査するかが異なる。本年度は、応用的・発展的文献をもとに、そのような制度間の相違の背景にある理論的基礎を調査した。様々な裁判所の関与の在り方を参照することは、合意制度における裁判所の役割を考察する上で多様な分析・比較を可能とする。さらに、その関与の在り方を正当化する根拠を明らかにすることで、わが国の法解釈にとっても有用な示唆を得られる。次に、米国の考察を参照しつつ、合意制度における裁判所の審査の在り方を考察した。合意制度では、裁判所は協議に関与せず、事後的に合意及び合意に基づく証拠を審査するに留まる。すなわち、裁判所は公判で検察官から合意内容書面の提出を受けて合意内容を把握したうえで、合意の履行を監督し、合意に基づく証言や供述の信用性を審査する。審査場面としては、合意をした協力者本人の公判及び協力対象である他人の公判とが考えられる。合意制度において検察官が恩典を付与する根拠はその訴追裁量権限（刑訴法248条）にあるとされることから、いずれの場面についても、裁判所は如何に検察官の訴追裁量を尊重しつつ、合意の適正化を確保するかが問題となる。本年度は、わが国における一部起訴や公訴権濫用論などの議論を参照して、当該問題を具体化することに努めた。さらに今後は、訴追裁量の限界を扱う判例・学説を考察することで、裁判所の審査の在り方について結論を提示できるよう研究を進める。

This year, the Ministry of Public Prosecution and Abuse of Public Prosecutions will make efforts to clarify this issue. In the future, the limits of litigation discretion will be examined in cases and theories, and the conclusions of judicial review will be suggested.
