本研究は、取引による処罰の公正さを確保しつつ、効果的な企業犯罪対応を実現するため、どのように協議・合意制度を構成すべきかを考察する。我が国の協議・合意制度は、標的者の処罰を実現するため、その捜査や公判に協力した協力者の処罰を控える又は軽くするものであることから、処罰の効率性と公正性が対立しうる。そこで、アメリカ及びイギリスにおける取引に基づく刑事処分をめぐる法状況・議論状況を調査・分析し、それを参考に効果的な企業犯罪への対応を実現するために、現行の合意制度をどのように改善すべきかを検討する。以上の構想に従い、令和4年度はアメリカ法の基礎調査を行うことを計画していた。具体的にはDPA・NPAに関する基礎的な文献を収集し、その理論的枠組や実際の運用状況について分析・検討を行った。DPA・NPAは企業犯罪を中心とする取引であるが、それに限らず、広く取引を用いた刑事事件の処理も視野に入れて情報収集を行った。そして、このようなアメリカ法の調査結果の一部を日本刑法学会において報告した。学会報告では、アメリカ法の分析をもとに取引一般に潜む危険・問題点を解明し、日本の合意制度において当該危険がどの程度妥当するのか、またその危険に制度上どのように対応するのかを検討した。検察官と被疑者・被告人の間の取引に基づき、刑事処分を決定することにどのような危険が伴うのかを明らかにすることは、公正な手続の実現にとって不可欠の前提をなすものである。また、取引に内在する危険に現行の合意制度がどの程度対応できているのか、対応できていない問題は何かを明らかにすることも、今後の合意制度の改善点を探る上で有意義な分析であったと考える。
