Human Rights of Irregular Migrants -From international human rights law and comparative law points of view-

本研究的目的是从国际法和比较法的角度讨论如何在面临驱逐时保护非正规移民及其家庭成员的人权。首先，我通过文献研究以及相关研讨会和座谈会提供的最新信息，了解了日本非正规移民的状况。然后，我分析了最近日本法院对驱逐案件的判决，并与欧洲人权法院（ECHR）的判决进行了比较。由此，我揭露了非正常移民及其家庭成员驱逐出境的一些问题，特别是有关保护儿童最大利益的问题。

The purpose of this study is to discuss how to protect the human rights of irregular migrants and their family members when they face to deportation, from both international law and comparative law points of view. First of all, I have gained an understanding of the situation of irregular migrants in Japan through literature-based research, and through the latest information provided at related seminars and symposiums. Then, I have analyzed the recent court judgments on deportation cases in Japan, and compared with the judgments by the European Court of Human Rights (ECHR). As the result, I have revealed some problems on the deportation of irregular migrants and their family members, especially the issues related to the protection of the best interests of the child.
