A Study on the Legal Status of Irregular Staying Stateless Persons

本研究的目的是确定和讨论关于无国籍人，特别是在日本非正常居留的无国籍人的法律的问题。第一，国籍登记不准确。这是官方统计数字没有反映日本无国籍人实际人数的原因之一。此外，有人指出，错误的国籍登记妨碍了无国籍人的民事生活，如婚姻或出生登记。第二，研究报告审查了无国籍状态和父母不正常法律的地位的代际循环的机制和挑战。因此，日本应实行准确的国籍核实制度/无国籍状态承认制度。最后，根据这一点，对菲律宾关于无国籍问题的法律的框架进行了比较研究，这一框架可能是世界上最先进的框架。

The purpose of this study is to identify and discuss the legal issues on stateless persons, especially the irregular staying stateless persons in Japan. Firstly, the inaccurate registration of nationality is revealed. This is one of the reasons why the official statistics do not reflect the actual numbers of stateless persons in Japan. Moreover, that the wrong registration of nationality creates impediment for stateless persons in performing their civil life, such as registration of marriage or birth, was pointed out. Secondly, the study examined the mechanism and the challenges of the intergenerational reproduction cycle of statelessness and of irregular legal status from parent(s). Hence, an accurate nationality verification system / statelessness recognition system should be introduced to Japan. In line with this, lastly, a comparative research on the Philippines' legal framework on statelessness that maybe the most progressive one in the world was carried out.
