The aim of this study is to reexamine the theory of service contracts from the perspective of intermediator's function. We choose real estate development agreements in France as an example. The classification of contracts for work and mandate contracts corresponds generally to the classification of objects of contracts. But, French case suggests that the qualification of both contracts should be based not only on what is the object of contract, but also on who bears the risk of transactions or on whose account they are carries out for.

本研究旨在从中介人功能的角度重新审视服务契约理论。我们选择法国的真实的房地产开发协议作为例子。工作合同和任务合同的分类一般与合同标的的分类相对应。但是，法国的案例表明，对这两种合同的资格不仅应基于合同的标的，而且还应基于谁承担交易的风险或为谁进行交易。
