2022年度は、本研究課題の最終年度に当たる。本年度においては、主として、①救済（remedy）の観点からの理論研究と②同性婚に関する下級審レベルの判例研究を行った。まず、①について、当初は、アメリカやドイツにおける憲法上の権利（constitutional rights）概念の理論研究から、「婚姻の自由」や「親権」といった本研究課題が対象とする個別的権利の法的性格の分析を試みていたが、本研究計画遂行中に、人権の救済法理論に関する英語文献（単著）の翻訳プロジェクトに参加することとなり、これを契機に、人権の救済法の分野における諸外国の判例や学説にも研究の対象を広げて考察することになった。将来的に同書の翻訳の出版（共訳）が別途予定されているが、翻訳の過程で本研究課題にかかわる興味深い判例や議論の存在を知ることができ、多くの研究上の収穫が得られた。例えば、救済法の文脈ではあるが、同性婚についての南アフリカ憲法裁判所の判決について分析し、近時の日本における同性婚の下級審判例と比較考察するという、今後の研究の展開を構想するための種々の素材を獲得することができた。次に、②について、昨年度に続き、本研究課題遂行中に、同性婚に関する新たな下級審での判決（大阪地方裁判所、東京地方裁判所）が下されたため、これらの判決の判例研究を行った。これらの判決に先行する札幌地方裁判所の判決について、既に昨年度中に2本の評釈を公表していたため、本年度は、この札幌地裁判決と上記２判決を特に憲法解釈方法論の観点から比較考察することに主眼を置いて研究を進めた。ここでの判例研究の成果については、令和4年5月頃にも名古屋地方裁判所での判決が予定されているため、同判決の評釈または一連の下級審判決の総合的な論説というかたちで今後公表することを予定している。
