项目摘要

本研究は、前年度に引き続き、同性婚の憲法解釈について比較法的な観点から考察を進め、最終的に主として次の二つの研究成果を得た。第一に、日本の現在の判例および学説の問題点として、婚姻の自由が憲法上の権利であることの基礎付けについて、十分に議論が蓄積されておらず、その権利性に関する共通認識が欠けていることが明らかになった。このことの原因としては、そもそも婚姻の自由が憲法上の権利として正面から研究の対象となってこなかったこと、さらには、その保障内容の具体化に際して、婚姻の自由が婚姻に関する法制度との関係が、常に必ずしも防御権的構成に見られるような対抗的関係を形成し得るわけではないことが十分に認識されてこなかったことが考えられる。このような議論状況に接して、本研究者は、ある権利や自由が「憲法上の権利」として位置付けられることの意義について改めて研究の焦点を当てる必要性があることを強く認識した。第二に、本年度は、ドイツにおける同性婚の議論の特殊性について明らかにすることができた。従来、ドイツにおいては基本法6条1項において婚姻に関する基本権の保障が展開されてきたが、そこでの「婚姻」概念には同性間の関係は含まれず、異性間の関係しか含まれないとするのが、連邦憲法裁判所の見解であった。しかし、ドイツでも同性婚立法が導入されたように、同法と従来の6条の解釈との間にどのような理論的整合性を保つかが重要な課題として浮かび上がっている。この難題を紐解く鍵は、次の二点にある。①第一に、ワイマール憲法以来の制度保障論とその派生物であるところの内容形成論との間の学説の変化について議論を整理する必要があり、②第二に、性的少数者に対する差別を審査を厳格化させる考慮要素として認識するようになった新たな平等権ドグマーティクが実質的に制度保障論を換骨奪胎するものとして用いられていることの評価についてである。
