本研究の目的は、債務引受という法制度全体の中で免責的債務引受と併存的債務引受の両法制度の関係をどのように整理することができるのか、という点を明らかにすることにある。この両債務引受概念は、19世紀後半から20世紀初頭にかけて、ドイツから我が国へと導入さたものである。2022年度は、ドイツにおける併存的債務引受概念の生成について明らかにすることを目的として、19世紀後半から20前半にかけてのドイツにおける同概念に関する文献を収集したうえで、併存的債務引受は免責的債務引受の対概念として位置付けることができるのか、という視点からこれらの文献を分析・検討し、研究会において報告を行った。ここでの報告内容については、営業譲渡と併存的債務引受の関連性についての分析・検討を踏まえたうえで、2023年度に論文として公表する予定である。上記のように、我が国における債務引受制度の議論は、ドイツにおける同概念の承継をその出発点とする。したがって、我が国における両債務引受の関係を検討するにあたっては、同概念に関する比較法的検討だけでなく、当時の日本民法学の方向性についても整理する必要があるといえる。日本においては、1890年代以降、多くの若い法学者がドイツでの在外研究を行っており、彼らのドイツでの修学は、我が国における民法解釈にも大きな影響を与えていたと考えられるからである。この点に関しては、ドイツ人の視点に立って執筆された鳩山秀夫研究を翻訳する形で、研究成果として公表することができた（（翻訳）大橋エミ「鳩山秀夫――20世紀初頭のボン大学における法学徒」法の思想と歴史第3号（2023年3月）99頁以下）。
