项目摘要

ファッションデザインのうち、出所識別力を備えるに至ったデザインを後追いで保護し得る不正競争防止法2条1項1号・2号の周知・著名表示の使用規制による保護について、日本において重要な判決が出されたため、その検討を行った。すなわち、女性用ハイヒールの靴底に付された色彩の保護が問題となった、東京地裁令和4年3月11日判時2523号103頁[ルブタンレッドソール一審]、知財高判令和4.12.26令4(ネ)10051[同二審]を中心とする検討を行い、色彩を主たる要素とするファッションデザインの日本における保護の現状についての分析を行った。特に、不正競争防止法2条1項1号・2号によって「商品等表示」としてデザインを保護する場合について、保護を求める対象の特定の在り方といった観点からの検討を中心的に行った。また、出願・登録なくして3年間に限り自動的にデザイン保護をもたらす不正競争防止法2条1項3号のデッドコピー規制の保護の在り方の検討を行うために、かねてより進めていたイギリスの非登録意匠権の検討を追加的に行った。特に、その保護要件である創作性（originality）についての検討を行った。さらに、日本法におけるファッションデザイン保護にかかる法制度の役割分担について、有斐閣Onlineロージャーナルで不定期連載されている座談会において、詳細な検討を進めており、既に著作権による保護（諸外国含む）、デッドコピー規制による保護についての議論を終えている。
