项目摘要

日本のファッションデザイン保護において重要な不正競争防止法2条1項3号（以下「形態模倣規制」という。）について、イングランド及びウェイルズ法（以下「イギリス法」という。）との比較に基づき、その保護要件・保護範囲・保護期間の在り方の検討を行った。イギリスには、出願・登録なくして自動的に3年間のデザイン保護をなす、EU非登録意匠権に由来する補助的非登録意匠権（Supplementary unregistered design）と、同様に自動的なデザイン保護をなすが、より長期間の保護を提供する（基本的に5年の独占権と5年のライセンス権の10年間である。）イギリス独自の非登録意匠権（以下「UK非登録意匠権」という。）が存在する。他方で、イギリスにおいては、同じく自動的な保護をなし得る著作権について、ファッションデザインのような実用品のデザインを保護することに謙抑的な立場が採用されている。かような法制度の役割分担において、イギリス法は日本法と類似性を有するが、形態模倣規制に対応するUK非登録意匠権の保護期間が日本よりも長期にわたるという相違も存在するため、日本における形態模倣規制によるファッションデザイン保護について、保護期間の在り方や、保護要件・範囲の具体的検討をなすに際して有益な示唆を得られうる。そこで、形態模倣規制とこれに対応するイギリス法の比較検討を行ったうえで、形態模倣規制の保護要件・範囲・期間の在り方を検討した。かかる成果については、博士論文として公表するために執筆を続けている。
