项目摘要

本研究は、子どもに対する性的虐待事案において典型的に観察される証拠・立証構造を言語化・明晰化し、それを踏まえたうえで、訴因の特定の在り方を具体化することを目的としている。これにより、検察官による訴追権限のより合理的な行使を促し、より子どもの利益にかなった事案処理の実現に寄与するとともに、訴因の特定に関する法理論の深化を試みるものである。初年度にあたる令和４年度は、証拠・立証構造という観点から、幅のある日時の記載をもって訴因の特定が認められている覚せい剤自己使用事案と比較することを通して、子どもに対する性的虐待事案においても幅のある日時の記載をもって訴因の特定を認めることができることについて検討を行い、その成果を「子どもに対する性的虐待の訴因における日時の概括的記載について」と題する論文にて公表した。具体的には、いずれの事案でおいても、尿の鑑定結果や子どもの供述などから、一定期間内に犯罪行為が少なくとも１回行われたことを強く推認することができ、それらの証拠が検察官の主張立証の中心となりうること、及びその証拠が示す期間以上に期間を限定しなくとも裁判所における審判対象の画定や被告人の防禦活動には問題がないことから、覚せい剤自己使用事案において判例・実務上許容されている訴因の特定の在り方が子どもに対する性的虐待事案にも妥当することを明らかにした。これらのことは、従来十分には言語化されてこなかった部分であり、証拠・立証構造と訴因の特定に関する議論を促進するものである。同時に、子どもに対する性的虐待事案において訴追を困難ならしめている要因についても明らかになったため、その点について、最終年度である令和５年度に調査・研究を行う。
