项目摘要

2022年度は交付申請書に記載した計画の通り、複合契約論との関係における契約相対効の原則の今日的意義の検討（総論的課題）、および契約の連鎖的消滅の法的構成の分析（各論的課題）という二つの課題について、フランス法との比較を行いながら考察を行った。まず後者の、契約の連鎖的消滅の法的構成の問題については、「複合契約の解除の法的構成に関する序論的考察― フランスにおける相互依存的契約の連鎖的消滅の法的構成に関する議論を中心として ―」帝京法学36巻2号（2023年）掲載予定を公表することができた。同論文は、契約の連鎖的消滅の法律構成について「失効」という構成を選択したフランス実定法の議論を検討することを通して、連鎖的消滅の法律構成の問題を考える上での視点の析出を試みるものである。本論文での分析を通して、複合契約ないし相互依存関係を有する契約の連鎖的消滅を正当化する発想として、消滅が問題となる契約の内的要因に着目する発想と（失効構成）、契約が他の契約と一定の特別な関係を有していることを前提に、外的な影響を受けて消滅するとの発想（拡張構成）が存在しうることを明らかにできた。その上で、従前の我が国の議論においては、前者の方向性を示すものが多いと考えられる中で、後者の発想から連鎖的消滅を基礎づける方向性もありうるとの知見を得ることができた。また、こうした契約の連鎖的消滅の法律構成の問題は、各論的な問題にすぎるものではなく、契約相対効の原則をどのようなものとして捉えるべきか、複合契約を構成する個々の契約を、古典的契約法理論が前提とする単一契約との関係でどのような意義を持つものとして理解すべきか、という契約法の総論的な問いを誘発するものでもある。そのため、同論文の執筆を通して得られたこうした問いや知見の存在は、上記の総論的課題に対する研究実績の一つとしても位置づけることができる。
