本研究の目的は、有罪判決に基づかない没収制度（non-conviction based confiscation）について、イギリスを比較法の対象として検討し、その日本への導入の是非について示すことである。研究計画としては、「＜課題１＞まず、日本における犯罪収益はく奪の制度を整理し、特に、犯罪収益はく奪の限界に関する判例や、学説からの批判について分析の対象とする。また、日本において犯罪収益はく奪の制度が刑罰的性格を有するものと整理された沿革についても整理する」こととしていた。もっとも、本研究課題を申請後、日本における犯罪収益はく奪の制度に重要な変更を加える法改正等が実施され、状況が大きく変化したため、課題１については依然として実施中である。むしろ、「＜課題２＞次に、イギリスにおける有罪判決に基づかない没収制度を構成する刑事没収及び民事回復について検討を加える。特に、刑罰的性格を有しないとする整理が同制度の基礎となっているため、その整理を可能にする理論的基礎にまでさかのぼった検討を行う」こととしていたところ、こちらをより先行させる形となった。すなわち、2023年6月に行われる第101回日本刑法学会における個別報告に、本研究課題の、特にこの課題２を中心的な内容とした報告希望申請をしたところ、結果として申請が通り、報告することとなっている。これに先立って、有罪判決に基づかない没収制度についての研究報告を、南山学会法学系列秋学期研究例会（2022年12月7日）および日本刑法学会2022年度第1回名古屋部会（2022年12月10日）において実施した。
