项目摘要

本研究の目的は、経済現象としての寄進・信託行為とその背後にある法規範との関係性を15-16世紀エジプトの事例にそくして検討すること、そしてその特質を他の文明圏の類例と比較するための視座を打ち立てることである。この目的の実現のために、2022年度はまず、エジプトのワクフ（信託財産）の運用形態をめぐる法学者の議論を参照し、15-16世紀エジプトでワクフ経営の手法が多様化したことの意味を、ハナフィー派の古典学説と15-16世紀エジプトのハナフィー派法学者の見解の差異のなかに探った。その分析結果を、日本オリエント学会第64回大会の企画セッション「前近代イスラーム史料研究の新地平」にて報告し、ワクフをめぐる新たな契約形態や規定がエジプトの慣行をどの程度取り込んでいるかを明らかにすることが次なる課題であるとの展望を得た。そのさい、エジプトを拠点に活躍した法学者を時代ごとに検討する必要があるのはもちろんのこと、ワクフをめぐる規定のなかには中央アジアの学説をそのまま踏襲したと考えられるものもみられるため、学説相伝の態様も含め多角的に検討を進める必要があるだろう。また、他の文明圏との比較にかんしては、中東・イスラム地域の低開発をイスラム法とのかかわりから説明するティムール・クランの「長い分岐」論を手掛かりとしつつ、ワクフを分析するための理論的枠組みと、それを歴史分析に適用するための方法論を探った。その成果は、論文「ワクフと経済発展：ティムール・クランの「長い分岐」論をめぐって」として『一橋経済学』（第13巻1号）に掲載された。この他、イスタンブル・スレイマニエ図書館での史料調査を予定したが、渡航直前にトルコ南東部で発生した地震の影響により渡航を断念せざるを得なかった。2023年度に再度調査を予定したい。
