项目摘要

研究目的は、法的な価値を社会事象に適用する法的思考と、紛争解決のための実践的な交渉技能の両者を合わせて育成する教育について、教育目標・教育内容・教育方法の各方面から体系的に検討し、系統立った法教育の教育課程を構築して検証することである。１年目にあたる今年度は、以下の３点に関して研究を進めた。第１に、本研究の基盤となる生徒の実態調査を行った。具体的には、法的思考や交渉技能を活用する際の認知バイアスをどの程度持っているのか東京都内の国立大学附属高等学校で質問紙調査を行った。その結果、法的紛争に直面した際、多くの生徒が固定資源知覚、アンカリング、代表制ヒューリスティック、フレーミングといった認知バイアスを持っていることが明らかとなった。第２に、法的思考学習、交渉技能学習、法構想学習の３つの学習を系統的に結び付けるためのモデルを検討した。具体的には、自主的な取り決めや私的な交渉で合意を形成して紛争を解決していくインフォーマルな法機能である「自治型法」、典型的な法類型で近代法の権利義務や要件効果といったいわゆる法的な思考様式を用いて裁判を行い、具体的事例ごとに法を適用して紛争を処理するという法の機能である「自立型法」、行政法や経済法のように、特定の政策目標の実現の手段として紛争を解決する法機能である「管理型法」からなる「法の三類型モデル」をカリキュラム構築のモデルとして採用することとした。第３に、交渉技能学習を開発し、実践を行った。具体的には、中学高校対抗交渉コンペティションの問題を作成し大会を主催した。本コンペティションには全国から７校、審査員・運営として法学研究者・実務家や教育学研究者・教員23名が参加した。作成した内容、新型コロナウィルスによって影響を受けたネットショップと運送業者の商取引に関する交渉である。時事的な問題であり、中高生の交渉意欲の向上がみられた。
