本研究は日本独自の制度である捜査・公判協力(他者負罪)型司法取引を対象とし、刑事法学上の理論研究および実務調査をもとに仮説を構築し、心理学の実験・調査手法による同仮説の科学的実証を行う。目的は1) 他国の「自己負罪型」司法取引制度と、日本の「他者負罪型」司法取引に類する制度の運用において生じている危険性の比較法学的研究、 2)心理学研究手法を用いた「他者負罪型」司法取引状況下でのリスク発生率とメカニズムの解明を通し、3)日本版司法取引制度の運用について客観的かつ科学的エビデンスを提出し、それに基づく制度設計・運用について提言することであった。まず初年度の研究計画としては、1)米国・司法取引制度の理論・実務調査や米国研究者らへのヒアリング、２）日本版司法取引である捜査・公判協力型（他者負罪型）司法取引場面の取引受諾についての心理学調査による基本データ取得を計画していた。とくに2）に関して、【調査１】場面想定質問紙法を用いて罪×罰×誘引を操作した司法取引場面の基礎的データを複数取得した。結果としては、米国等の自己負罪型と比較して他者負罪型では、１）自らが犯罪を行っていることが明確な有罪条件では取引受諾率が同等に高い、２）一方自らが犯罪を行っていないことが明らかな無罪条件では取引受託率は低い、しかし３）無罪条件であっても取引受諾（虚偽自白）が一定数存在することがが明らかとなった。また【調査２】欧米の自己負罪型と日本の他者負罪型証言の比較を同時に行う実験・調査も実施したところ同様の結果が得られた。加えて【調査３】裁判員を想定した第三者による自己負罪型と他者負罪型で得られた証言の信用性評価について検討したところ、他者負罪型よりも自己負罪型において供述の信用性および被告人の有罪判断が高いことが示された。ただし他者負罪型で証言を行った供述者に対しても有罪とする傾向も明らかとなった。

This study aims at the research of Japanese independent system, the construction of theoretical research and practical investigation in criminal law, the research methods in psychology, and the scientific evidence of the same theory.
