项目摘要

平成6年度は、重点領域研究「情報化社会と人間」の最終年度であり、これまでの研究成果を踏まえつつ、「情報公開と個人情報保護」について、研究を継続した。その結果、かなりの成果をあげることができた。情報公開(情報へのアクセス権)については、日本の国レベルでもその制度化の検討が行政改革委員会行政情報公開部会で開始されるようになった。このことの意義は、きわめて大きい。「情報公開と個人情報保護」班の代表者は、行政改革委員会行政情報公開部会の専門委員に任命されたので、これまでの研究成果を国レベルの検討に活用することができる。この1年間、先進国における情報公開法の運用・制定論議、日本における情報公開条例の制定・運用について貴重な経験が積み重ねられてきている。これらの情報を収集するとともに、その分析を行った。アメリカについては、情報化社会を支える新たな情報技術(ニューテクノロジー)と情報公開の関係等を引き続き研究した。その他の国についても検討を加え、さらに、日本の地方自治体の制度等について調査研究した。個人情報保護(自己情報へのアクセス権)については、国レベルで1988年制定の個人情報保護法が運用されている等の実績があり、情報公開法との関係で研究する必要性が出てきたいる。その際、参考になるのが、1970年代から80年代にかけて個人情報保護法・データ保護法を制定した先進諸国の例である。また、新たな問題に対処するため、1990年代に入ってからも様々な試みがなされている。特にアメリカの動きが重要であり、それについて引き続き研究した。さらに、アジアにおいても個人情報保護への関心が高まり、韓国では、1994年に個人情報保護法が制定され、1995年初めにに施行された。これについても検討した。
