法律エキスパートシステムを、法律家の知的情報処理の支援システムとしてとらえると、法律判例データベースは、現に実用化されている情報処理システムとしてかなり似ている。また、エキスパートシステムの中核部分をなす法知識ベースは、一種のデータベースととらえることができる。本年度は、ドイツの官製のデータベースであるjuris(ユーリス)を使う方法論を整備し、「短い」婚姻継続期間に関してデータベースの有効性を検証した。また、重点領域研究の共通素材である国際物品売買契約に関する国連条約(ウイーン売買条約/CISG)が適用された事例について検索し、さらに法学雑誌やUNCITRAL等の資料との対照をおこなった。jurisに特徴的な検索の道具のなかでとくに法分野の分類(Sachgebiet)と適用法規の連鎖的な指示(Normkette,NK)の応用を研究した。また、当該判決の引用された判決/文献から影響史をあとづける試みをおこなった。ドイツの判例に関しては、UNCITRALが収集した資料よりも完備していて、しかも全世界の関連判例のなかでドイツの判例が先駆的な重要性をもつことが確認されたので、原文との比較検討と詳細検索をおこなう必要を確認した。個別事例解決のグループ化と一般ルールの抽出、決疑論から体系構成法への道筋を明らかにするための問題設定をおこなった。意思表示、契約成立、売買、所有権移転などの一般的な問題点についても同様の準備研究をおこなった。CD-ROMの利用とon-line検索について比較検討した。全文データが増加しているところから、言葉使いから論旨を理解する方法を研究した。juris以外のデータベース利用への準備をおこなった。
