古典期ローマ法のその後の時代での受容と変容は、実質的な法規範内容に関するものと形式に属する法学方法論に分けて論ずることが必要である。ローマ法学は、ギリシャ以来の西洋古典世界の伝統である対話方式による議論の中で形成され、また、(実質的価値判断を正面に出さず)形式論理と類推を頻用する。(この視点を用いれば、たとえば従来不完全テキストと批判されてきたD.28,7,28(パーピニアーヌス)が的確に理解しえる)ディオクレティアーヌス帝は専主制を確立し法学にも多大の影響を及ぼす。従来、ディ帝による実質法の変更の例として、勅法C.4,44,2(285年)および、C.4,44,8(293年)による、半額以下の土地の売却を無効とする、いわゆる莫大損害laesio enormisの導入が挙げられている。しかし、ディ帝発布勅法を通覧すると、契約ないし合意解消を認めるものは、284-290年の5例のみに限られ、以降は一旦なした合意の拘束力を繰り返し強調するもののみで、解消を認めたものがない。ディ帝の若年者原状回復制度の当初の積極的運用・拡大(国庫あるいは25歳以上の者への適用)の一環として、例外的に勅法で認めたが、その後これを根拠に多数の契約解消申請が殺到したため以降は、契約遵守を強調せざるをえなくなったと解することを正当としよう。このことは、同時代人、ビザンツ法学、卑俗法において、莫大損害制度に言及がないことをよく説明する。ディ帝下の法学において、形式論理が引続き重視されたか否か、また古典時代の自由な精神のもとで成立した対話方式が継承されえたかは、今日の我々の法学にとっても切実な問題であるが、今後の課題として残る。
