農業法人への多様な出資・寄付参加の形態は、【encircled1】農業生産法人への資本出資・現物出資、【encircled2】市町村農業公社への多様な構成員による出資・寄付、【encircled3】第3セクター営利法人への出資、などがある。平成9年度の研究では、前年度の調査を継続するとともに、K県における複数市町村による農業公社設立構想について、調査を行った。また、農産物加工・販売あるいはグリーン・ツーリズム関連事業による農業法人に関する概況調査を実施した。調査の結果明らかになった諸点は、以下のとおりである。【encircled1】農業生産法人への県公社からの農地の現物出資制度はほとんど活用されていない状況である。法人構成員による買取期間が長期間にわたるため、県公社・担当者がリスク負担に耐えられないようである。【encircled2】公社への出資・寄付は農協の場合に困難を伴う。損金算入が認められていないため、総会などでの合意を取り付けるのが難しい。【encircled3】第3セクターによる地域農業維持法策は一定の効果をあげているが、自治体主導になるために経済活動が制約される。【encircled4】「非営利組織」の形態に期待が高まっている。市民参加が得られやすい形態である。【encircled5】女性の起業活動による法人設立が活発化し、出資も「多様な構成員」によっている事例が多い。農業法人と関連した一般法人を視野に入れた調査研究が不可欠である。多様な構成員による農業法人の展開は可能性に富んでいる。継続的な研究が必要である。また、「非営利組織」の制度化が一般市民を構成員に加える形態をして、期待されている。
