项目摘要

2022年度は、日本学術振興会の若手研究者海外挑戦プログラムによりイギリス・ノッティンガム大学に滞在し、Dirk van Zyl Smit名誉教授の下で約1年間研究を行った。主な内容は、（１）イギリスにおける近年の仮釈放制度改革の実態調査、（２）日本およびイギリスにおける仮釈放制度・運用と社会の関心の関係の分析、（３）終身刑受刑者の仮釈放に関するヨーロッパ人権裁判所の判例分析である。（１）イギリスにおいて2018年以降行われている一連の仮釈放制度改革の分析を行った。また、2022年に開始した仮釈放口頭審問の一部公開制度を利用し、無期刑受刑者の口頭審問を傍聴した。これにより、イギリスにおいて実際にどのように仮釈放の公開審理が実施されているのかを観察した。（２）イギリスにおける制度改革を受けて、日本における仮釈放制度・運用の展開を仮釈放に対する社会の関心との関係という観点から分析した。日本とイギリスでは保安や応報に対する社会の関心が仮釈放制度の展開や運用に対して異なった影響を与えていることを明らかにし、オックスフォード大学で行われたThe Howard League for Penal Reformの学会で研究報告を行った。（３）さらに、人権の観点から無期刑・終身刑の仮釈放に対して何が求められるかを考察するため、イギリスの無期刑・終身刑の仮釈放制度に大きな影響を与えているヨーロッパ人権裁判所の判例分析を行った。また、ヨーロッパ人権裁判所の判例法理の普遍性を考察するため、仮釈放のない終身刑を有する法域への犯罪人引渡に関する当裁判所の判例、当裁判所の判例を参照した自由権規約員会の判断、ヨーロッパ人権裁判所の判例法理を参照したカナダ最高裁の判例などの分析も行った。

In 2022, a number of Japanese researchers from the Japan Society for the Promotion of Science conducted research for about one year under the honorary professor Dirk van Zyl Smit. The main contents include: (1) Investigation on the reform of the criminal justice system in recent years;(2) Analysis on the relationship between the criminal justice system, application and social concern in Japan;(3) Analysis on the case law of the criminal justice system for life sentence. (1) Analysis of the reform of the system of public security since 2018. In 2022, an open system of oral interrogation of prisoners was introduced. This is the first time that a public hearing has been conducted. (2) Analysis of the impact of institutional reform on the development of social concerns in Japan The Howard League for Penal Reform Research Report (3) To investigate the influence of the life penalty and life penalty on the judicial system of the People's Court and to analyze the cases of the People's Court.
