项目摘要

2022年度は、ドイツのハンブルクを拠点とした在外研究を行った。第一に、マックス・プランク研究所が作成した中世の法文献に関する写本データベースにおいて、今回研究対象としている著作の一部を発見した。このデータを用いて、ヨーロッパ各地の図書館に史料の撮影を依頼した。また併せて、ハンブルク大学に所蔵されていた著作『モーセ法・ローマ法対照』の近世印刷本を撮影した。加えて、ランゴバルド法とローマ法を比較する異同文献の1912年に出版された刊本を入手した。第二に、現地の研究者との交流と意見交換を行った。ハンブルク大学での学術報告シリーズに出席したほか、スイスのチューリヒで開催された『法史家大会』およびベルギーのブリュッセルで開催された『国際古代法史学会』（SIHDA）にも参加した。両学会ともに、学会報告の参観や参加者との意見交換によって、本研究の内容についても重要な示唆を得ることができた。第三に、日本では入手が困難な、ローマ法とカノン法の関係に関する文献およびランゴバルド法に関する先行研究を収集した。加えて、調査を進める過程で関連性を検討するようになった、後期古代の法文献『モーセ法・ローマ法対照』に関する先行研究をも収集した。第四に、各史料の来歴や時系列に着目した整理を順次開始した。第五に、2021年度より続けていた、ザクセン法における命令不服従学説の成立において異同文献が果たした役割についての研究の成果を、雑誌『法と文化の制度史』に査読付き論文の形で発表することができた。

In 2022, the company started to conduct research in the field.
