项目摘要

初年度にあたる本年度は、研究計画に概ね沿って、(1)特定の国際機構の権限行使の態様の研究および(2)国際機構法の一般理論研究を並行して行うことができたと考えている。以下、簡単に進捗を報告する。(1)については、加盟国から国際刑事裁判所（ICC）への権限移譲と同権限の後者による行使に関する包括的な最新の先行研究を綿密かつ批判的に検討する内容の研究報告を6月に行った。その作業によって、ICCの権限に関する現状の議論状況と先行研究の不備の特定を行った。具体的には、ICCの権限をめぐる先行研究は、同権限を加盟国からの被移譲権限として説明する立場と、国際共同体に内在する刑罰権として説明する立場に二分されているが、これらを二項対立的に捉える姿勢自体の問題性や国際機構法の一般理論を踏まえた視点の必要性が明らかとなった。(2)については、各国際機構の具体性を超えて一般理論を構築するために必要な前提を洗い出す作業を行った。具体的には先行研究において国際機構法の「パラダイム」として同定されるfunctionalismの検討をし、重要と考えられる先行研究を検討する内容の研究報告を、国際法研究者の集う私的な研究会にて8月に行った。functionalismは国際機構をエージェント、加盟国をプリンシパルとする一種のエージェント理論であるが、その学説史的起源を探ることにより、国際機構法研究が前提としがちなfunctionalismには更なる前提（国際行政連合的な国際機構観や、国際機構の善性の措定）が存在することを指摘し、その偶有性を一定程度明らかにすることができた。
