项目摘要

1, 質問紙による調査: 体罰の実態についての認識, 体罰についての規範意識, 体罰の教育的効果についての意識等をあきらかにするため, 教師(小・中・高)2010名, 生徒とその父母(中1, 高1, 高2)2320名, 合計4340名を対象として調査を実施(61年10月〜11月)した. 62年度にその集計, 基礎解析を行い, 教師, 父母, 生徒三者の実態認識及び意識構造の関係について解した. また, 地域的差異, 学校種別間の差異, 学校運営上の傾向性との関係等興味深いデータが得られた. なおまた, 自由記述らんへの記入等が極めて高かったこともひとつの特色をなしている.2, 事例研究: 岐阜県立中津商高, 岐陽高校, 埼玉県所沢市立向陽中学, 横浜市立下瀬谷中学, 東京都江戸川区立清新第一小学校, における体罰事件をとりあげ, 事件の経緯・事件の生じた要因, 事件解決, 体罰根絶の方途を究明した. 要因に関しては, 関係教師の指導観・性格を並んで学校運営・教育行政のあり方が重要な意味をもっていること, 解決・根絶の方途に関しては, 父母有志組識, 県民組識, PTA, 弁護士会が大きな役割を果していること, 及びそれに起因する長所・短所が存在することが明らかになった.3, 裁判過程研究: 水戸市立第五中学事件(民事・刑事), 静岡市立安東中学校事件(民事), 岐陽高校事件(刑事), 中津商高事件(民事)の4件を取上げた. 体罰事件・問題が裁判過程において, 原告, 被告, 弁護人, 裁判官によってどのように法的に扱われていくのかを法社会学的に解明した. 裁判の構造, 立証・証言のあり方と, 弁護人, 検察官・裁判官の法知識, 法意識の特質が明らかとなった.4, 歴史的・理論的研究: 日・米・英の教育史, 教育法制史の検討を行い近・現代教育における, 生徒処遇の具体像をあきらかにし, そのよって立つ原理の仮説的提示を行いうるに至った.
