项目摘要

1.本研究は、(1)70年代後半以降の「司法審査制論争の検討、(2)アメリカ司法審査制の歴史的性格と構造の分析、(3)戦後アメリカ憲法理論諸潮流の特徴と相互の対抗関係の明確化、(3)アメリカ憲法理論主流をなすリベラリズム憲法論への批判的分析をおこなう「批判法学潮流の理論的特徴の分析、(4)以上を通じて、わが国のアメリカ憲法研究の視点の見直しを課題とする。2.60年度では「司法審査制論争の分析を手がかりに、戦後アメリカ司法審査制の歴史的性格と構造の分析を主眼とし、これにもとづいて、戦後アメリカ憲法理論諸潮流の基本的位置づけをおこなった。61年度では、まず、アメリカ憲法理論の主流をなすリベラリズム憲法理論の特徴の分析と、これに対する原理的批判をおこなうマーク・タシュネット等の「批判的法学潮流の分析をおこなった。これは現在なお継続中であるが、これまでの私のアメリカ憲法研究をふくめて、「アメリカ司法審査制と憲法理論(仮題-日本評論社)としてまとめる予定で、その主要部分の執筆を62年度中に完了するべく、作業をすすめている。63年度中に出版する予定である。3.なお、政治学分野からもアメリカ憲法理論の検討が進行しているので、これについての分析もおこなった。4.また、アメリカ憲法理論に多くを学んできたわが国の憲法訴訟理論への批判的分析も同時に追求してきたが、これは別途、あらためてまとめる予定になっている。

This study consists of: (1) a discussion of the controversy over judicial review since the late 1970s;(2) an analysis of the character and structure of judicial review history;(3) a clarification of the relationship between the characteristics of constitutional theory trends;(3) an analysis of the mainstream of constitutional theory and criticism of constitutional theory;(4) The above issues are related to constitutional research. 2.60 The analysis of the judicial review system controversy, the analysis of the character and structure of the judicial review system history, the analysis of the basic position of the constitutional theory, the analysis of the judicial review system controversy, the analysis of the judicial review history, the analysis of the judicial review history. In 1961, the main stream of constitutional theory was analyzed and the principle of criticism was criticized. "Judicial Review and Constitutional Theory"(Japanese Review Agency) and "Pre-determined" and "Main Part" were written in the middle of 2006. 63 years of publication scheduled. 3. Political science is divided into two parts: constitutional theory and analysis. 4. The theory of constitutional law should be studied and analyzed critically, and the theory of constitutional law should be pursued simultaneously.
