今年度の研究は大きく二つの点から進めた。一つはこれまでの諸先学の研究成果を再検討し、その引用史料の整理を行なうことにより、室町幕府訴訟制度の研究の問題点を把握することである。このため、学生アルバイトを併用して、これまでの研究で特に重要と思われる(1)石井良助氏の『中世武家不動産訴訟法の研究』(2)小川信氏の『足利一門守護発展史の研究』(3)森茂暁氏の『南北朝期公武関係史の研究』の以上三点の著作で引用されている史料のサード整理を行なうとともに、国立公文書館・東大史料編筆所架蔵の当該史料の調査を行なった。これに先立って、室町幕府研究のこれまでの研究成果の整理と今後の課題について、日本史研究会中世史部会の席上で報告した(昭和61年4月15日、近日『日本史研究』誌上にイ報として紹介予定)。いま一つは京都府立総合資料館所蔵の「東寺百合文書」中にみられる諸引付の記事中より室町幕府の訴訟に関連するものを捨い出す作業を行なった。予算の関係上、当初予定していた応仁期までの計画は断念せざるをえなかったものの、一応南北朝期をX1-として、京都府立総合資料館に写真焼付を依頼し、その読解作業を進めた。しかし、読解作業は大変難解なものが多く、現在までのところ所期の予定していた段階を完了していない。今後、出来るだけ早い時期に作業の終了を果たす予定である。ただ、その作業を進めるうちに東寺より室町幕府に提出した申状の分析を行なったが、その結果、種々の新しい知見が得られた。ここでそれを列記することは字数の制約の上から不可能であるが、近々『史林』に投稿する予定である。なお、今後の研究は、上述した「諸引付」の読解作業を続けていくことにより、とりわけ、諸権門内部で訴訟面において室町幕府の果たした役割を中心に、守護とのかかわり方、また、社寺などの対応などを出来るだけ具体的な事例を数多く収集しながら追求していきたいと思っている。
