本研究では、史上第三の移民流入期にあるアメリカの移民・マイノリティー教育をめぐる諸問題を、イ.連邦政府の地方に対する補助金政策の一環であるバイリンガル教育に関する法制定過程、2.これに対応する地方・州の法制整備とその運用、3.近年におけるこれをめぐる粉争事件等を通じて、浮き彫りにすることが課題であった。第1の点では、'68年に少数言語(language minority)の子どもの教育上の必要に対応する最初の主要連邦法と評価される法の制定を見たが、その主要因には、(1)60年代の公民権運動の高揚、(2)南西部のメキシコ系市民の組織化と教育機会の平等要求及びその方途としてのバイリンガル教育の有効性の認識が指摘される。またそれ故に、当初からバイリンガル教育は、単に言語教授技術上の問題にとどまらず、極めて政治的性格を滞びざるをえないことが上・下両院の議会資料(Report、Hearing)の分析から指摘できる。さらに'68年法制定後、'74、'78、'84年と改訂され、'87年にも改訂が試みられているが、これらの連続性、つまり断えず制定の過程にある法制度であるという側面とともに、夫々に固有な立法背景・性格を有するという点で別途法変遷に対応するバイリンガル教育の変容を捕捉する作業が必要であると思われる。次に50州におけるバイリンガル教育の法制上の扱いは、今日なお教授上の使用言語として英語のみを規定する若干の州が存するが、英語以外の言語を許容する州が多数を占め、この傾向は80年代に強まっていることが明らかである。しかし第3に、'82年連邦最高裁判決(Plylerケース)以後の移民・マイノリティーの教育上の地位はバイリンガル教育それ自体の変容及び英語公用語化運動の一部州での成功を見るとき、一層安定してきているとはいい難い。文化背景を異にする多様な人種・民族の融合・共存という現代的課題の達成にはなお困難がある。
