本研究によって得られた成果は以下のようである.イ.´86年新移民法(PL-603)に関して得た立法資料及び研究等によれば, 近年の新移民に対する連邦制作はhalf open doorからより制限的となりつつあることが明らかである. しかるに, 国内外の主に経済的要因によって不法・違法移民の流入, 残留さえ, なお不可避と見られる. (イ)本研究ではテキサス州を中心にメキシコから(系)の移民の実態に触れる報告及びその先行研究例を募集・整理した. (2)次に´68年教育法(PL90-247)により定礎された新移民・マイノリティーに対するバイリンガル教育(費援助)政策の変遷を議会資料と教育省バイリンガル教育局等の若干の資料でその概観を得た. (3)他方, 旧移民に対して人種・民族が夫々に自己のアイデンティティーを主張する新移民の時代への変化に対応し, 州レベルでも30余州がバイリンガル教育を政策としていることが州教育法の分析により明らかになったが, 連邦政策の変化と関連して, その実施上には言語問題も絡んで, 種々の問題点の噴出が見られる. これらの解明にはなお新たな検討を要する.2.次にバイリンガル教育を支える教育制度理念を解明すべく, (1)移民に対する教育の歴史を基本文献等により把握するとともに, (2)テキサス州´75年法(EDu・CODE・ANN・§21・03イ)に端を発する違法外国人(移民)児童の公立無償学校からの排除策とこれに伴う一連の訴訟事件の整序を試みた. (3)次に´82年連邦最高裁判決により決着したPlylerケースを中心に判決例とそのケート・ノートの分析を通して移民の教育上の地位の確定を試みた. 違法外国人児童に公立無償教育を承認する判例法の安定度の高さはなお検討の余地があるにせよ, 我国の実情から見てその将来に示唆的な結論が得られた.
