(1)研究の発端となった、ルイジアナ州とテキサス州の裁判所間で相反する判決を生ぜしめたEicke v.Eicke(La.App.)399 So.2nd 1231の追跡を通して、同事件の持つ問題性と州際間の判決の抵触状況の部分的ではあるが、一応の理解を得られた。(2)他方、上述した州際間の判決の抵触をかもし出す基底には、州レヴェルにおける州の裁判管轄権の決定のあり方がある。従来、州の裁判管轄権は、他州にとっては不可侵であり、その反面、州の独自性が保証されていた。今は、この状況は一変しつつある。例えば、監護権と密接な関連を有する委託(placement)の領域においても、「子供の委託に関する州際間協約」が州レヴェルの立法に採択されるなど、州の立法において、こうした問題を積極的に対処せんとしている。わけても、「統一子の監護に関する裁判管轄権」を定めたカリフォルニア州家族法はその典型であると云って過言ではない。州の裁判管轄権の問題は、連邦レヴェルでの解決を迎えてきた。こうした点で、過去における判決の抵触の問題も様変りしてきたのである。(3)当初、本研究は、「親による子の誘拐防止法」の制定過定を明らかにすること、また、国際民事訴訟法にむける同事件の「子の利益」の分析にまで到らなかった。これらについては今後の検討としたい。なお本研究の過程で、カリフォルニア家族法の翻訳を刊行することができることになった。
