项目摘要

ユ-ゴスラビアは「自主管理社会主義」を標榜して、独自の道を歩んできた。ところが、88年憲法修正を前後して、危機からの脱出を模索するなかで従来の路線を大きく転換して「自主管理」も「社会主義」もともに放棄する方向が強まった。それに民族間紛争も加わって「連邦制」の再編ないし解体の志向もこれに運動した。こうした析に、この変動過程と新たな憲法的枠組みの模索を追った本研究は,まずは従来の社会・国家体制の基本原理を定める74年憲法体制の批判的総括を行なうことを要請した。ユ-ゴ自体でもこの研究はそれほど本格的ではなく、いかなる社会体制かという問題を脇において,当面の危機脱出の処方せん作りに集中している状況にある。従来より継続してきた共同研究の成果をまとめるにあたって、基本的には執筆後であったが、この74年憲法体制の総括という観点からの分析を最大限に生かすう努めた。90年には各共和国で選挙があり、新しい諸政堂が乱立し、4つの共和国では非社会主義もしくは民族主義志向の政党が勝利した。こうした中で、新しい憲法構想も公表され、その検討も進むが、その成立への取り組みは本格化しえないでいる。本年の研究課題の下、こうしたユ-ゴでの事態の経緯の正確なフォロ-とともに、過去のものの全面的清算ではなく、そこから自由で民主的な真の協同社会をめざしたユ-ゴの経験のもつ重みを汲み尽すべく研究に取り組んだつもりである。発表した成果にもその特徴は現われていると思う。この課題を継続しつつ、「ユ-ゴ自主管理社会主義の経験をその歴史的限界」をテ-マとするような研究を続けたいと考えている。

"Self-management socialism" is a new concept. Before and after the amendment of the Constitution in 1988, there was a great change in the direction of "independent management" and "socialism". The dispute between the nationalities intensified and the "union system" was reorganized. This paper reviews the basic principles of the future society and state system and reviews the critical process of the constitutional system in 1974. The study of self-determination is based on the situation of social system, problem and crisis. The results of joint research over the past few years have been achieved, the basic ones have been achieved after writing, and the analysis of the comprehensive and comprehensive aspects of this 74-year constitutional system has been carried out to the maximum extent possible. In 1990, the republics were elected, the new political houses were established, and the republics were not socialist. The Constitution of the People's Republic of China has been revised, and the Constitution has been revised.
