環境刑法という我国では未開の分野に、従前蓄積してきた知見の補完と集成を通じて、理論学的にも立法論的にも本格的な踏み跡の第一歩をつけようとするのが本研究の目的であったが、知見の補完という点においては大きな成果を上げ得たものの、集成という点においては尚相当の時間を要するレヴェルに止まることとなった。即ち、ここ数年、ドイツでは第2次環境犯罪取締法案へと結実する議論の大進展が、また米国でもEPAの刑事執行へのプライオリティ-の付与、大気汚染防止法や油濁汚濁防止法の改正、更には連邦環境犯罪取締法案提出へと至る大きな立法等の展開があり、夥しい論策や資料が公表され、多くの新たな知見を得た。特に、我国において法益保護説と結び付きつつ一種の政策命題として刑事制裁発動に反対してきた行政従属性論が、理論学的レヴェルでは行政的に管理された人間利益としての法益構想に至る傾向を有し、自然環境自体を保護しようとする生態系的法益構想を阻害し得ることが明らかとなった。また、既に汚濁された環境媒体(法益)の保護を超えた刑事制裁の形成的機能の必要性も確認し得たが、それを現在の刑法体系論中に組み込み、整合的な実定法解釈論を展開してゆくことは、国際条約関連法等に見られる純粋に生態系保護を目指した罰則のそれと共に、早急な立法的解決を要求するということも明きらかとなった。企業組織体処罰理論や新たな刑罰制裁形態論については、特段新たな展開は見受けられなかった。法と経済学・社会的選択論の批判的考察も従前の視座に特に付加するものはなかったが、その学習自体は大変有益であった。このように補完された知見・情報は相当量に上り、その論文化には尚暫くの時間が必要である他、立法論を展開する上では今春の刑法学会でのワ-クショップ「環境刑法」等の展開動向を見極める必要もあるように思われる。今後は、研究の集成を鋭意推進する予定である。
