組合内における組合員(分会・支部)相互間の利害対立が集団的労働法理にいかなる影響を与えるかを協約法理、団交法理、不当労働行為法理と関連づけて解明することが本研究の基本的目的である。今年度は、組合の内部対立がどのような形態において、また、どのような経緯で発生し、それが集団的労働法理、とりわけ不当労働行為法理にいかなるインパクトを与えるかを研究した。そのために、主要労働委員会(中労委、都労委、神奈川地労委、愛知地労委等)において、参考となるケ-スのヒヤリングを行った。申立、調査、審問の一連の手続においてどのような形で組合内対立があらわれるか、またそれらの対立が労働委員会手続上どのような問題を提起するかを考察した。その結果これらの問題の多くは和解等の任意的処理によって解決されているので命令や裁判の型で現出しないことがあきらかになった。同時に、これらの紛争の型は極めて多様であり(組合対組合員のケ-スや組織対立のケ-スがあるばかりでなく、対立の原因が人間関係による場合も少なくない)また、労働委員会はあくまで固別事業毎の処理をしていることが理解できた。協約法理や団交法理との関連性をあきらかにするためには、今後労働関係者からのヒヤリングが不可欠である。特に、組合内部における協約締結に向けた意思決定がいかになされているかの解明が重要と思われる。
